Breaking News: Federal Judge dismisses Trump classified documents case over concerns with prosecutor's appointment.
More Chinks in the Democrap's Lawfare
We have talked extensively about this lawfare against Trump on SheeLilly and I believe that this case should have never been brought for a couple of reasons:
First of all, sTrumpet was POTUS when he took the documents. Every POTUS does it and only the POTUS can declassify (I am against the profligate classification of documents) documents. Secondly, the Cadaver in Chief also retained docs WHILE he was Senator and Veep. Never as POTUS. The CiC was “investigated” and even though he had no authority to steal the docs AND he showed them to a journalist, the DoJ declined to prosecute because he’s “old, sympathetic, and forgetful.” Sigh.
To be sure, if sTrumpet was on trial for extra-judicial murders (ie; Gen Solemaini of Iran) or “inventing” the crime against humanity known as the Covax, I would be on board. But, all of the lawfare cases have been spun from whole cloth and designed to hamper, imprison, and impoverish political opponents. All of the lawfare cases are falling apart because they had no basis in reality and the prosecutors are being exposed for the greedy DemShills that they are.
The GOP led House has hammered AG Merrick Garland for the unconstitutional appointment of Jack Smith and, I guess, the judge in Florida Eileen Cannon agreed:
WASHINGTON (AP) — The federal judge presiding over the classified documents case of former President Donald Trump in Florida has dismissed the prosecution because of concerns over the appointment of the prosecutor who brought the case.
U.S. District Judge Aileen Cannon granted the defense motion to dismiss the case on Monday, voiding a prosecution that at the time it was brought was seen as the most perilous of the multiple legal threats Trump faced.
Lawyers for Trump had argued that special counsel Jack Smith was illicitly appointed in violation of the Constitution’s Appointments Clause that his office was improperly funded by the Justice Department.
Smith’s team had vigorously contested the argument during hearings before Cannon last month.
A spokesman for the Smith team did not immediately return a request seeking comment, and the Trump team did not immediately have a comment. (ORIGINAL LINK)
